Long version- I purchased an HKS EVC V from Gary on May 21. He sent it and it arrived damaged (one of the nipples had broken off during shipping). I called him and he agreed to file a claim with UPS. When he filed the claim, he asked me to take it to UPS to show them. I agreed to, but at the time I did not have a chance to take it (~25 minutes away from me). After a little over a week, UPS decided to pay the claim. (I had not taken the controller to them, and Gary said that they no longer needed to see it). Gary said to send it back and he will refund my money. At this point I had no reason to not trust him so I sent it back. I told him that I didn't mind just keeping the controller and not getting a refund (I was going to fix the broken nipple). He insisted that he wanted to do it this way, and I figured I'd rather have the money than deal with installing it. When he received it, he texted me telling me that he would refund my money when UPS sent him the claim money. Well, UPS changed their mind and said that since I never took it to them they wouldn't refund it (Gary is the one who talked to them and he told me that they accepted the claim and I didn't need to take it). Then he told he needed to get some check that he was waiting on and it would be a week before he could refund the money. After that week, there was some issue and the check was delayed... Now, he will not respond to my texts and I got screwed out of $257. I gave him too much time, and now Paypal's dispute will not do anything other than make a dispute on his record. As a buyer, I did everything I could to be understanding about what was happening. Maybe he really is in a hard spot, but that is no reason to screw me over and stop responding to me.
